Driver Identified

The driver who struck Pat Sawyer from behind was identified in today’s Tribune. According to the Tribune, the recommended charge will be “failure to stop at a traffic accident resulting in death” (LINK).

WHAT KIND OF CHARGE IS THAT?
How about charges of reckless driving, failure to yield right-of-way, and involuntary manslaughter? Of course the driver can always claim ‘the bike swerved into my path at the last minute’. Unfortunately, no one is alive to dispute this claim.

Here’s another law that was broken.
“9-21-8-5. Overtaking and passing of vehicles proceeding in the
same direction — The following rules govern the overtaking and
passing of vehicles proceeding in the same direction, subject to
the limitations, exceptions, and special rules stated:
(1) A person who drives a vehicle overtaking another vehicle
proceeding in the same direction shall pass to the left of the
other vehicle at a safe distance and may not again drive to the
right side of the roadway until safely clear of the overtaken
vehicle.”
Cleary, the driver did not pass “at a safe distance”. Cleveland road, at the site, is 4 lanes!
